NCJW Alarmed at Nomination of Judge Neil Gorsuch to Supreme Court

January 31, 2017, Washington, DC – The National Council of Jewish Women (NCJW) today announced its strong opposition to the nomination of Judge Neil Gorsuch to fill the vacancy on the US Supreme Court. NCJW CEO Nancy K. Kaufman released the following statement:

“As an organization that has fought for equal rights for all since 1893, NCJW is deeply alarmed by Judge Gorsuch’s nomination to the US Supreme Court by President Trump. Judge Gorsuch has repeatedly denounced women’s reproductive and religious freedoms, voting to uphold the right of employers to refuse to pay for health insurance that covers all forms of contraception. He also argued in favor of allowing organizations to deny contraceptive coverage without even filing a waiver for a religious exemption. The group argued that the mere act of filing the waiver was a violation of their religious freedom, and Judge Gorsuch agreed, thereby giving groups the right to deny contraceptive coverage under federal health plans without even stating a reason.

“Judge Gorsuch is an opponent of class action lawsuits that are a critical tool to fight employment discrimination. He has a constricted view of allowing agencies to issue rules and regulations that promote progressive government policies on behalf of women, people of color, consumers, and workers. He harshly condemns those who have turned to the courts to advance LGBT equality and enforce church-state separation in the context of school, claiming such legal strategies use the courts inappropriately to debate public policy.

“NCJW believes that only those women and men committed to upholding constitutional rights and fundamental freedoms should be confirmed to lifetime seats on the federal bench. Unfortunately, Judge Gorsuch, through his court opinions and essays, has made clear that he has no respect for the constitutional principles that have supported the progress made by women and minorities throughout our country’s history.

“NCJW urges the Senate to undertake a thorough, independent review of Judge Gorsuch’s record and its complete lack of respect for mainstream constitutional values. NCJW will continue to fight for religious freedom, reproductive freedom, and equal rights, as well as our most precious democratic values. We urge the Senate to ultimately reject the disturbing nomination of Judge Gorsuch to the Supreme Court.”
